To nit pick here, they can talk to him. They can't talk to him about working there while his contract is ongoing, no. But they can talk to him about signing a contract now to work there when his Sirius contract expires.
That's precisely what happened between Sirius and Howard Stern in 2004. In 2004, he was under contract to Infinity. But that contract didn't prohibit him from exploring his post-contract employment opportunities.
