Probably the latter. It's also not unknown for an applicant to file for a facility they have no real intent of building, in hopes of being bought out as part of a settlement window like this. (I have no reason to believe that's the case in this specific window, mind you.)
There's no requirement that applicants specify a format these days, and unless the applicant is specifically targeting an ethnic audience (Polnet or Zev Brenner), any promises that might have been made in 2006 might or might not make sense in 2010, anyway.
I also wouldn't read too much into the "Indian Point" thing - it was a convenient bit of legal smokescreen to cover the political favor being done for WRCR. It's not as though WHUD doesn't completely cover the Indian Point evacuation zone on both sides of the Hudson, after all...and probably with a significantly better signal than the new 1700 will have.
